1. Definitions

For the purposes of these Terms and Conditions:

• "Service" refers to the food tours, culinary experiences, and related services offered by Lumivane.
• "User," "You," or "Guest" refers to any individual who accesses our website or participates in our services.
• "We," "Us," or "Our" refers to Lumivane, the service provider.
• "Agreement" refers to these Terms and Conditions along with our Privacy Policy.
• "Website" refers to our online platform accessible at lumivira.

2. Acceptance of Terms

By accessing our website, booking a tour, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

You must be at least 18 years of age to book our services. Minors may participate in tours when accompanied by a parent or legal guardian who accepts these terms on their behalf.

3. Service Description

Lumivane provides guided food tours and culinary experiences in Kuala Lumpur and surrounding regions. Our services include:

• Street food walking tours
• Multi-day culinary exploration packages
• Cooking classes in heritage settings
• Market visits and ingredient education
• Fine dining experiences with cultural context

Service availability may vary based on season, local events, and partner establishment schedules. We reserve the right to modify tour itineraries when necessary due to unforeseen circumstances.

4. Booking and Payment

4.1 Reservation Process

Tour bookings can be made through our website contact form, email ([email protected]), or phone (+60 3-9463 7281). All bookings are subject to availability and confirmation from Lumivane.

4.2 Payment Terms

Full payment is required at the time of booking to confirm your reservation. We accept the following payment methods: bank transfer, credit card, and other methods as specified during booking. All prices are listed in Malaysian Ringgit (MYR) and include applicable taxes unless otherwise stated.

4.3 Pricing

Tour prices include all specified meals, tastings, cooking classes, transportation between venues, and guide services as outlined in the tour description. Prices are subject to change without notice, but confirmed bookings honor the price at time of reservation.

5. Cancellation and Refund Policy

5.1 Cancellations by Guest

• More than 14 days before tour: Full refund minus 10% administrative fee
• 7-14 days before tour: 50% refund
• Less than 7 days before tour: No refund

5.2 Cancellations by Lumivane

We reserve the right to cancel tours due to insufficient bookings, weather conditions, safety concerns, or unforeseen circumstances. In such cases, we will offer a full refund or alternative tour date. Our liability is limited to the tour fee paid; we are not responsible for travel expenses, accommodation costs, or other consequential damages.

5.3 No-Shows

Failure to attend a confirmed tour without prior cancellation will result in forfeiture of the full tour fee with no refund.

6. Guest Responsibilities

6.1 Health and Safety

You are responsible for ensuring you are physically capable of participating in walking tours and culinary activities. You must disclose any dietary restrictions, allergies, or health conditions that may affect your participation at the time of booking.

6.2 Conduct

You agree to conduct yourself respectfully toward guides, other guests, restaurant staff, and local communities. We reserve the right to remove any guest whose behavior is disruptive, disrespectful, or unsafe, without refund.

6.3 Punctuality

You must arrive at designated meeting points at the scheduled time. Tours will not be delayed for late arrivals, and no refunds will be provided for missed portions of tours due to tardiness.

7. Intellectual Property

All content on our website, including text, images, logos, tour descriptions, and educational materials, is the property of Lumivane and protected by Malaysian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from our content without written permission. You are granted a limited, non-exclusive license to access and use the website for personal, non-commercial purposes only.

8. Disclaimers

8.1 Service Provision

Our services are provided on an "as is" basis. While we strive to ensure accurate descriptions and high-quality experiences, we make no warranties or guarantees regarding the outcome of your tour experience.

8.2 Food Safety

We partner only with establishments that maintain proper health and safety standards. However, we cannot guarantee that food-related illnesses will not occur. You participate in food tours at your own risk.

8.3 Third-Party Establishments

We work with independent restaurants, markets, and venues. We are not responsible for the actions, quality, or services of these third-party establishments beyond our tour arrangements.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Lumivane's liability for any claims arising from your use of our services is limited to the amount you paid for the tour in question.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data loss, personal injury, property damage, or emotional distress arising from your participation in our tours.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lumivane, its owners, employees, guides, and partners from any claims, damages, losses, or expenses (including legal fees) arising from: your violation of these Terms and Conditions, your conduct during tours, your breach of any law or regulation, or any claims made by third parties related to your participation in our services.

11. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather, pandemics, government actions, civil unrest, strikes, or acts of terrorism. In such cases, we will work with you to reschedule or provide alternative arrangements.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which can be found at lumivira/privacy-policy.html. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

13. Dispute Resolution

13.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13.2 Informal Resolution

Before pursuing formal legal action, you agree to contact us at legal@lumivira to attempt to resolve any disputes informally. We commit to working with you in good faith to reach a mutually satisfactory resolution.

14. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

For significant changes that materially affect your rights, we will provide notice via email to registered users at least 30 days before the changes take effect.

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
